经济法是以尊重市场机制为前提而产生和发展起来的。经济法不是要否定市场调节的作用 ,而是为了纠正市场调节的固有缺陷 ,以维护市场调节的基础性作用。为了维护市场调节的基础性作用 ,经济法不但要纠正市场失灵 ,也要纠正政府失灵。从本质上说 ,经济法是基于社会整体利益 ,为了确保市场经济正常运行和国民经济持续发展 ,对社会经济生活中的私人权利和国家权力进行引导、规制、平衡的法律规范体系。
