道德量刑与法律的非社会化——从法律社会学视角看道德量刑

北京市丰台区法院在对一起刑事案件的被告人进行量刑的过程中,首次尝试以"社会调查报告"的形式加入道德判断标准,此举引发了热烈的讨论。从法律社会学视角来看,道德量刑在执行过程中将产生不可避免的误差,且会大量增加法律判罚中的社会因素,造成法律歧视,不利于法律判罚的公正性。所以,道德调查不应纳入量刑参考体系。

Moral Sentencing and the Dissocialization of Law——A Discussion from the Perspective of Law-sociological

Fengtai District Court in Beijing has tried to use the "social investigation report" to add moral standard to the judgment in a criminal case.This triggered a lively discussion.Considered by law-sociological perspective,there will be a lot of inevitable errors in the process of the "social investigation report" and it would also increase the social information in the case which leads to the discrimination in the court.All of these will result to the unfairness in the legal punishment.So,the conclusion is that moral standard should not be added to the legal punishment.
