互联网对传统以物理时空为理论基点的冲突法理论和规则的冲击,透过技术或制度层面,实际上可以归结为网络社会对管辖权的挑战,也可以说是网络所带来的时空转换导致各国争夺网络管辖权的竞争。晚近提出的诸多网络管辖权理论及理论基础,如＂新主权论＂、＂管辖相对论＂和＂网址论＂等都是为本国在新的国际空间中扩张提供理论基础。合理的互联网规制有待于各国在这一＂虚拟空间＂领域不断有效地合作。
