共同危险行为若干问题之我见

共同危险行为（又称准共同侵权行为）是数人侵权的一种重要类型,其理论研究亦由来已久,但我国立法上的认可尚不过十年。立法的逐步认可并未消除理论上对此的分歧,如共同危险行为人承担责任的基础为何、＂高空抛物致害之诉＂与共同危险行为的关系、共同危险行为的免责事由等等。
