| 摘 要： | 国际法的有效性是国际法中一个重要的理论问题,作为国际法渊源之一的一般法律原则在国际司法中能否得到援引和适用也是国际法有效性的一个重要体现。尽管理论上存在争议,但实践表明,一般法律原则得到了国际司法或准司法机构的适用,虽然比较少,但却是重要的,从司法角度充分显示了一般法律原则的有效性。

| Abstract: | Validity is an important theoretical issue for the international law.Whether the principle of the general law,a source of the international law,is applied is an embodiment of the validity.In spite of the theoretical disputes,the principle of general law has been applied by judicial organs.The validity is shown from judicial angle though less in number. |
