教育制度的习得性失效及其矫治

摘    要:所谓教育制度的习得性失效,是指人们参照他人或既往应对经验,对教育制度采取有意为之乃至习以为常的改变或变通,结果导致教育制度低效或无效运行的现象。这种教育制度的习得性失效主要表现为教育制度的虚假和不公正运行,对教育制度的不合理变通及"多数人暴政"现象。造成这种现象的原因主要是教育制度目标群体的执行主体地位缺失及制度运行过程中存在的官僚主义和寻租行为等。为此,我们应当真正实现教育制度运行的民主化、公开化,建立完善高效的制度运行监控机制,努力提高制度执行人员的素质,建立有效的责任追究和奖惩机制,健全制度运行的信息沟通机制,尽可能降低制度运行的交易成本,从而确保教育制度运行的良好效果。

Abstract:The failure of learned education system is a phenomenon that people,according to other or past experience,change or modify intentionally and even habitually the education system that gives rise to the operation in low efficiency or inefficiency.That is not something new,so it is easy for people to have "learned" to ignore the existence.However,it often leads to the failure of education system,and hence makes it lose its proper specifications and guiding role.For the legal education system,therefore,it does not mean that the more provisions of education system one introduces,the more problems one can easily solves.If one does not pay attention to pursuing the running results of education system,or enforces the law strictly,no matter how many system and provisions one introduces,they would not help at all.
