反致制度的思考和分析

国际私法之反致制度尚存在许多明显的缺点，其利弊之争一直不断，但从反致的历史发展及客观现实来看，该制度能够更好的实现国际私法的目的与宗旨。并且反致制度仍在向前发展并呈现出被普遍采用、适用范围趋同、被例外采用时又力图克服其弊端的发展趋势。鉴于反致制度将长期存在并发挥它的例外协调作用，我国的冲突法在立法和实践中也应进行研究和探索。

Thinking and Analyzing of Remission Systems

There exist some weak points in the remission system of international private law and the argument against its advantages and disadvantages never stops.However,from the historical development and objective reality of remission,the system can better realize the aim and gist of international law.Moreover,the remission system is developing and presenting a tendency to be general used in the same range and its disadvantages be overcome when exceptionally used.The remission system will long exist and play its role of exceptional coordination and the conflict law should be studied in the practice and legislation.
