从人性视角探讨法的价值

法的价值问题是法律科学所不能回避的问题，其本质上是一个关于人的问题，建立在不同主体对彼此内在需要相互承认和调和的基础上。从横向的部门法视角划分，不同部门法侧重对人性不同方面的肯定，其价值取向存在差异；从纵向的时间维度来看，法价值和人性之间存在着互动，是一个相互塑造的历史过程。

Probing into the Value of Law from the Perspective of Humanity

In essence, ＂the value of law＂ is a question about human nature, which is based on the acknowledgment and reconciliation of intrinsic needs of different human beings, and could not be avoided in the legal science field. From the perspective of horizontal departmental law, different departmental law places emphasis on different needs of humanity, whose value orientation is varied. And from the perspective of longitudinal time, there exists a interaction between the value of law and humanity, which are moulded mutually with the times.
