邓小平立法思想初探

改革开放初期，围绕实现国家现代化目标，立法怎样为其服务成为法制建设中的重要问题。为此，邓小平提出建立和完善以宪法为核心的法律体系，设定了保障民主的立法目标和步骤，同时提出了立法方法和要求。其立法思想有三个显特点：十分重视立法的正义性，提出立法正义的三条标准；重视立法与经济、政治、社会发展之间的关系，强调其相互作用和影响，并描述了我国立法前景；要求着眼借鉴，创制世界上最好的法律制度。这些对当今我国立法和整个法制建设仍有诸多启示。

A Consideration on Deng Xiao-ping Regislative Thought

Soon after China's opening to the outside world, there appeared the problem of how regislation should better serve the realization of modernization, which is an important issue in China's legal construction. Under these circumstances, Deng Xian-ping suggested establishing and perfecting the constitution-centered legal system, and determining the regislative objective and procedures to maintain democracy. Meanwhile, he also pointed out the method of making law and its requirement. Deng Xiao-ping regislative thought has three outstanding characteristics. First, it stresses on the justice of regislation and mentions three standards to judge it. Second, it emphasizes the relationship between regislation and economy, regislation and politics, regislation and social development, their mutual relations and influence. In addition, it also depicts the prospect of the regislation. Third, it suggests establishing the best law system by drawing lessons from others. Nowadays this thought still gives us a lot of inspiration in making law and the construction of law system.
