| 摘 要： | 刑事法律应该有团结功能。具有团结功能的刑事法律,需要轻刑的、矫正的、人性的法律要素和结构。通过刑事法律宣告,巩固社会团结;通过轻刑,减损社会团结,通过矫正;恢复社会团结。我国刑事法律团结功能有待改善,应大幅度减少死刑,矫正成本放在定罪量刑依据构成的首位,及时保护被害人利益,保障罪犯合法权利。

| Abstract: | Criminal law should have the function of unity.With unity and function of the criminal law,need to light punishment,correction,the legal elements and structure of human nature.Through the criminal law declared,consolidate social solidarity;through the light punishment,impairment of social solidarity,through correction;recovery of social solidarity.China＇s criminal law unity functions need to be improved,should substantially reduce the death penalty,correction of costs on the conviction and sentencing basis constitute the first,timely protection of the victims＇ interests,safeguard the legitimate rights of criminals. |
