| 摘 要： | 在财产性犯罪案件中，对行为人所获得的财产数量的正确认定是定罪量刑的前提。本文通过犯罪嫌疑人在实际侵犯财产行为过程中以及获获得财产后的主观心理状况和所取得的财产的实际价值状况出发，指出应当如何对行为人非法占有财产进行具体数额进行正确的认定。

| Abstract: | In the property crime cases, it＇ s the precondition to correctly judge the value of property acquired for the conviction and measurement of penalty. Based on the process of the criminal suspects＇ property violation crimes , their subjective psychological state and the actual value of property that they acquired, the paper summaries the way how to correctly judge the amount of illegal property. |
