权利是法律有机体的细胞，民法是权利的集中表现。本文从政治、经济、文化角度分析了中国古代民法不发达，权利匮乏的根源。阐明了传统民法文化良莠并存，中国现代民法文化建设，是在批判继承传统民法文化基础上融入现代法治精神的交融同构过程。

Poverty and Overstep--Reflections on the Traditional Culture of Civil Law

Right is the basic component of law as to Civil Law is the basic expression of right. The article analyses the roots of the backwardness of Civil Law and the lack of rights in old China from the perspective of politics, economy and culture. The article also points out that traditional Civil Law culture is a complex existence of advanced and less-advanced culture and the construction of modern Civil Law culture is a mingled process of infiltrating modern rule-by-law spirit based on critically inheriting traditional Civil Law culture.
