| 摘 要： | 在分析非物质文化遗产的权利性质是带有公权性质的私权基础上，进而对如果直接适用现有的知识产权法律来保护非物质文化遗产存在的一些障碍进行探讨。最后提出我国非物质文化遗产知识产权保护制度的构建，重点分析论述我国如何利用知识产权法的三种保护方式对非物质文化遗产进行综合保护。

| Abstract: | On the basis of the analysis of the nature of non-material cultural heritage,this thesis explores some barriers that exist in protecting non-material cultural heritage under direct use of existing intellectual property rights law,puts forward the construction of non-material cultural heritage protection system in China,and analyses three ways used to protect non-material cultural heritage. |
