| 摘 要： | 在我国高等教育体制转型和教师人事制度改革的过程中,公立高校与教师之间的法律关系问题日显突出。我国现行的聘任制背景下,公立高校与教师之间不是单纯的劳动合同聘用关系,而是具有契约自由色彩和公共利益优先色彩的行政合同关系。
