论全国人大代表无权投弃权票

本文首先归纳了国内学术界对于弃权票的态度,并做简要的评述。接着在对弃权票背后理论依据作充分的辨析之后,明确了本文所依据的理论基础,结合我国的实际国情后认为：全国人大代表投弃权票会破坏全国人大代表的先进性和广泛性,不利于真实反映人民的利益和意志,不利于全国人大会议做出科学合理、符合全民利益的决策,从而破坏了人大会议特有功效的发挥。因而得出＂应该取消全国人大代表投弃权票的权利＂的结论,并希冀从这个角度为我国人大制度的改革提供一个新思路。

On Deputies Having No Right to Abstain from Voting

With the brief comment on domestic scholars＇ attitudes towards abstention vote this paper makes a full analysis of the theory behind abstention vote in the current situation of the National People＇s Congress and then points out that abstention vote destroys the deputies＇ basic traits,which can＇t reflect people＇s real interest and willings.Also it hinders the Congress to make scientific and sound policies for the interest of the people.As a result,it will destroy its certain functions.The paper comes to the conclusion that the Deputies have no right to abstain from voting,in the hope of providing a new idea for the reform of the People＇s Congress.
