| 摘 要： | 我国现行立法只是从原则上规定了律师负有保密义务，而且多相互冲突，对保密义务实现的保障制度也没有作出规定，容易导致实践中律师对委托人保密义务的名存实亡，使律师执业陷入法律规定和司法实践的双重困境。该文试从真实义务和保密义务的平衡中阐述适合中国特色律师保密制度构建的法理思考。

| Abstract: | In China, legislation in force only stipulates the confidential of a lawyer in principle, most conflict each other, and doesn't stipulate the safeguard system of fulfilling the confidential duties, which will fall into the double predicament but in name of a lawyer's confidential duties to his client in practice. This paper explains that the lawyer's confidential system with Chinese characteristics should be established between the balance of real duties and confidential duties. |
