建立法官过错责任追究机制研究

要确保法官公正行使审判权，必须有严格的监督制约机制作保障。对此，我国的现行立法和实践都存在着明显的不足，需要在总结经验和借鉴国际成功做法的基础上，建立以司法机关自律与权力机关他律相结合的过错责任追究机制，通过科学透明的惩戒程序来确保司法公正和效率目标的实现。

Establishment of the Mechanism of Finding Out the Fault Made by Judges

Strict supervision restriction mechanism should be established as a guarantee,if it is ensured for judges to exercise judicial authority justly.So there are evident inadequancies in the existing legislation and practice,on the basis of summing up the experience and using the successful practice of other countries,the mechanism of finding out the fault liability made by judges,which combines the self-discipline of judicial offices with the discipline of authorative offices by others,should be established so as to make sure to realize judicial just and efficiency objective by scientific and transparent publishment procedure.
