| 摘 要： | 在刑事政策实践中存在着两种倾向 ,一是过分强调刑事政策的功利性目的 ,功利目标湮没了道德目标 ;一是片面地理解刑事政策的道德目标的内容 ,只强调对犯罪人的人权保护 ,也就是只关注犯罪人处遇问题 ,忽视对犯罪被害人和社会一般公众的权利保护和道义安慰。文章讨论了刑事政策的道德目标和功利目标之间的辩证关系 ,阐明全面完整地把握刑事政策的目标的重大现实意义

| Abstract: | There are two aspects to be noticed in the implementation of the criminal policy, one being the over-emphasis on the material gain of the criminal policy and neglecting the moral standard, the other being overlooking the interest of the victims and the general mass by misunderstanding the criminal policy, emphasizing on the protection of human rights only. The present paper discusses the relationship between moral standard and material gain and states the practical implication of grasping the purpose of the criminal policy. |
