| 摘 要： | 中国刑事诉讼证人不出庭作证既是一个法律问题，也是一个社会问题。为此，在完善证人出庭作证制度的基础上，允许在一定条件下书面证言的存在是解决中国目前证人不出庭作证现状的一种理智选择。
