| 摘 要： | 交易婚是无结婚合意的男女双方为了实现其个人目的,事先通过协议约定而成立婚姻,待其目的实现后即解除婚姻关系的一种婚姻现象。究其本质,这种婚姻就是当事人之间的一种交易行为。为了防止交易婚呈逐渐扩大态势而对社会产生严重不良影响,应该对其进行有效规制以维护社会的公序良俗。文章通过对交易婚产生的原因、法律性质和效力进行深入分析,最后建议我国修改婚姻法第10条和增设结婚登记宣誓制度,完善相关婚姻法律制度,以实现对该种婚姻合理规范。
