| 摘 要： | 特别权力关系理论排斥法律保留原则、否定司法审查，有侵犯人权、蔑视人性尊严之弊端，应予以彻底检讨与反思；要修正与抛弃不合时宜的落后理论，以维护人性尊严，保障基本权利，实现法律的公平与正义。

| Abstract: | The theory of special power relationship excludes the principle of law reserve and jurisdiction, infringe human rights and contemn human dignity. It is time to have a thorough reconsideration of the above mentioned phenomena and have a revision of the theories in order to protect human dignity and basic rights, and carry out justice. |
