关于制定地方民办教育管理条例的思考

民办教育促进法及其实施条例的出台对于促进我国民办教育的发展具有重大意义。但是,由于我国地域辽阔,各地经济和社会以及民办教育的发展差异很大,单靠国家层面的法律无法解决全国不同地区民办教育发展所面临的各自问题。因此,地方民办教育管理条例必须重视上位法尚未解决的核心问题,必须重视本地区发展需要的适用性,切实制定出适合本地区民办教育发展的具体实施办法,使国家法律和地方法规紧密结合起来。

Thinking on Enacting Regional Civilian-run Education Management Byelaw

The enacting of the Law of promoting civilian-run education of P.R. China and its byelaw are significant to the development of civilian-run education; however, China is with a vast territory, and its regional economic level and educational development are very different among the regions. The problems of different regions during the development of civilian-run education cannot be solved only by the national law; therefore, regional civilian-run education management byelaw should attach importance to the key issues that national law has not solved yet and the applicability of regional development. There should be detailed measures to fit the development of regional civilian-run education in the byelaw and to integrate closely the regional codes to the national law.
