| 摘 要： | 随着数字技术的发展,默示许可制度成为网络环境下版权保护的新问题。基于网络搜索服务的默示许可制度,是实践中的自生自发秩序。关于这种默示许可制度的法律地位,学界有不同的见解。结合现实状况和未来趋势,可以将默示许可视为网络搜索领域的基本原则。默示许可在平衡网络搜索服务商、权利人和社会公众利益之间有着积极的意义。在网络搜索服务领域,应全方位引入默示许可制度,为搜索技术的发展扫清法律障碍。
