我国公民考试权利初探

本文从对设立公民考试权利的法理分析出发,经探讨比较公民考试权利与受教育权利,归纳了公民考试权利的五项内容,即公民享有取得一定考试资格的权利,公民享有参与考试的权利,公民享有获得相符的考试成绩的权利,公民对考试成绩有复核审查的权利,公民有基于考试成绩取得应获权益的权利,并对这几个方面进行了详细的分析,呼吁《考试法》尽快出台,对公民考试权利予以充分细致的规定,以解决目前我国考试制度中诸多不合理事项并对考生权利予以完善的保障。

A Probe into the Citizen's Examination Rights

This paper begins with the analysis of legal principle of citizen exami- nation rights,then discusses and compares the examination rights with education rights,concluding with the content of citizen' s examination rights in 5 aspects and analyzing all the details,that citizens possess the rights to achieve the ex- amination qualification,citizens possess the rights to participate in examination, citizens possess the rights to get the corresponding examination achievements, citizens possess the rights to check and examine their achievements and citizens possess the rights to gain deserved interests on the basic of examination achievements.In addition,this paper appeals to draft the examination law as soon as possible.A definite and detailed law can solve many unreasonable problems about examination procedure in our country and ensure the students' examination rights completely.
