| 摘 要： | 在校大学生的法律地位是指大学生作为教育法律关系主雄的地位．是大学生参与、接受教育活动中形成的权利与义务的统一体．在校大学生兼具被管理者和平等民事主体双重法律地位。大学生权利意识的觉醒给现有的教育和管理模式带来前所未有的挑战．高校应当在尊重、保障大学生民主参与权的前提下．依法行使自主管理权。
