张族鳥及其《龙筋凤髓判》整理研究述略

唐张鷟为一代文豪,其著作甚多,但多已亡佚,今存者只有《游仙窟》、《朝野佥载》、《龙筋凤髓判》三种专著和《全唐文》中收入的两篇文章。《龙筋凤髓判》是国内目前传世的最早的一部官定判词。其书内容十分广博,遍涉盛唐时期包括皇亲国戚、三省六部官员、地方州县官吏乃至庶民百姓。判词今存80条,从呈报、审理、复核、裁决各方面较为完整地展现了唐代的司法程序。为辨彰中国古代法制、考镜古代法制的源流提供了极其宝贵的文献资料。《龙筋凤髓判笺注》校勘了今存的九个版本,详加注释,为阅读和继续研究《龙筋凤髓判》判定了基础。

A Review of ZHANG Zhuo and his Collection of Key Law Cases

ZHANG Zhuo, a literacy giant, writes a large amount of works, among which most has been lost and only remain three monographs of visiting a fairy cave, collection of bizarre stories in court administration and Collection of Key Law Cases and two articles collected in collection of Chinese literature in Tang Dynasty. Collection of Key Law Cases, the earliest official collection of law cases that can be found exist in China, covers a large number of cases on royal members, officials of central government, local officials and common people in Tang dynasty. The existed 80 items of record in this work reveals a comparative complete picture of juridical procedure in Tang dynasty from aspects of reports, trial, check and adjudication, which constitutes a valuable document in the research of ancient Chinese legal system and its origins. The book Notes to ＂Collection of Key Law Cases＂ collates and emen- dates with interpretation and illustration the existed 9 versions of Collection of Key Law Cases, and provides founda- tion for the further reading and study of Collection of Key Law Cases.
