论析毛泽东法制成就有限之因

毛泽东思想内容丰富,包括政治、经济、哲学、军事、教育、文学艺术等方面。毛泽东对于中国革命的贡献是勿庸置疑的,他对中国革命和建设实践的一系列独创性经验作了理论概括,从而形成的毛泽东思想,是我们长期的指导思想。然而,纵观毛泽东的著述和言论,对于法制方面的论说较少,甚至很多时候和法制精神相悖,其很多非法制的言行与我们今天建设和谐社会的法治要求更是背道而驰。这样一个伟人,为什么会在法制方面的成就有所欠缺?原因很多,可以从多个方面去分析,本文拟就其对法制认识进行剖析,试图找出其深层的原因,为今天的和谐社会建设,提供有益借鉴。

On the Cause of Limited Achievements of Mao Zedong in the Legal System

Mao Zedong Thought is rich in contents,including politics,economics,philosophy,military,education,literature,art,and so on.There is no doubt that Mao Zedong contributed a lot to the Chinese revolution.He generalized a series of unique experiences from the practice of the Chinese revolution and construction,and thereby formed Mao Zedong Thought,which is our long-term guiding ideology.However,we find that there are few contents about legal system among Mao's works and remarks.And even a great deal of his remarks are opposite to the spirit of legality,which distinctly runs counter to the requirement of building harmonious society with consummate law and order.Why did Mao disregard the legal system while he won great successes at other aspects? There are many reasons.And we can analyze from different aspects.This paper focus on Mao's understanding of the legal system and try to identify the underlying reasons.The author hopes this paper could provide a useful reference for today's building of a harmonious society.
