我国数字作品的版权保护问题

在数字技术高速发展的今天 ,中国版权制度的修订必须体现与其他国家基本一致的措施。所有的复制 ,不论暂时的还是永久的 ,都应视为版权意义上的复制。我国在修改《著作权法》过程中对数字作品的复制要有特殊的规定。集体管理制度可以解决许多权利人自己无法解决的问题 ,并帮助权利人最大限度地实现其利益。为了建立数字作品版权管理的集体管理组织 ,可采纳美国、欧美和日本学者们的立法建议在著作权法中增订相应的条文。

Copyright Protection of the Digital Works in Our Country

Today, digital technology is developing at a high speed. The revision of China's copyright system must reflect consistency with other countries. All t he duplication, no matter temporary or permanent, should be regarded as the dupl ication with copyright. The Copyright Law should make special regulation on the duplication of digital works. Collective management system can solve many proble ms and help copyright holders realize their interests to the maximum extent. In order to set up the collective management organization on copyright management o f digital works, we can revise and add corresponding clauses in the Copyright La w according to the propositions concerning legislation from certain scholars of U.S.A., America and Europe and Japanese.
