| 摘 要： | 国际商事仲裁中的临时保全措施,主要问题及争议存在于临时保全措施的决定与执行两个方面。在我国,要完善国际商事仲裁中临时保全措施的决定和执行,必须做到:商事仲裁中临时保全措施决定权应该由法院与仲裁庭分享;应该立法规定法院可以发布临时保全措施支持外国仲裁并规定承认与执行外国仲裁临时保全措施的问题;应该立法规定法院可以发布临时措施支持外国仲裁。

| Abstract: | To the temporary preservation measures in the international business arbitration,the main problems and disputes exist in the two fields,decision and implementation.In China,in order to perfect the decision and implementation,the decision-making power must be shared by both the court and the arbitration tribunal and the law should be made that the court can release the temporary preservation measures in support of the arbitration made in foreign countries and the arbitration in foreign countries for temporary preservation measures must be admitted and conducted. |
