论体育争端的非讼性裁决机制的建立

运用民法学、行政法学、仲裁法等相关理论，对当今体育纠纷的争执特点、表现性质和解决途径进行分析。认为，体育纠纷已越来越多地具有民商事纠纷的性质，而与之相适应的法律救济途径却显得匮乏。说明体育争端的解决，很大程度上将依赖于非讼性民商事裁决的规范；ADR、仲裁是解决体育争端的手段。

Discussion on Establishment of Non-lawsuit Adjudication Mechanism of Sports Disputes

The present paper has analyzed the feature, nature of expression and solution of disputes of the current sports disputes with the relative theory of civil law, administration law and arbitration law, etc. It holds that the sports disputes have more and more nature of civil action, while the original law can't function, which shows that the solution of sports disputes will depend to a great extent on the standard of non-lawsuit adjudication. ADR and adjudication are effective ways to deal with ports disputes.
