| 摘 要： | 辽代是公元10世纪由契丹贵族在北方建立的少数民族政权,在100多年的立国过程中形成了一套完整的法律刑罚原则。但其法律刑罚原则一方面由于受游牧民族习惯和君主至上之权的干涉,不断遭到破坏,另一方面,这也是契丹游牧文明和中原汉文明互相借鉴、融合的结果。

| Abstract: | The Liao Dynasty is a minority regime established by the Khitan nobles in the north in the tenth century,and in its existence of more than one hundred years,a complete set of legal principles of penalty has formed.These principles result from the mutual reference and fusion of Khitan nomadic civilization and Han civilization.At the same time,these principles are also interfered and damaged by the nomadic habits and the monarch’s supreme power. |
