论高校学报的著作权归属

高校学报的著作权归属主要涉及到三类主体：学报编辑部、作者和其他出版主体。著作权法是确定著作权归属的根据，但是，著作权法对学报著作权归属的规定使这个问题复杂化。从学报编辑部的角度论述了三类主体间的关系，依法厘清学报的著作权归属，并设法避开著作权法对学报编辑部的权利限制，使学报编辑部最大限度的获得学报的著作权。

On the Copyright Ownership of University Journals

As far as the copyright ownership of university journals, three types of subjects, including editorial board, author and publishing house, should be taken into consideration. The ownership of copyright should be in the light of The Law of Copyright, which, unfortunately, makes the problem even more complicated. This paper illustrates the relationship among the three types of subject from the perspective of editorial board. Furthermore , this paper tries to straighten out the copyright ownership of university journals, refrain from the right limitation , and ensure that the copyright belongs to editorial board of university journals.
