| 摘 要： | 海域使用权是一新颖的物权,且属于典型物权中的用益物权,而非准物权。它同渔业权存在着效力冲突,其实渔业权本可被海域使用权吸收。为此,本文试就海域使用权的内容、性质以及与土地权并列的不动产权类型等,来探讨《物权法》存在的弊端,进而从海域物权法律制度设计提出一些建议。
