| 摘 要： | 网络著作权侵权问题层出不穷,因网络用户未经许可上传他人享有版权的的视频而引起的上传者和权利人之间的纠纷便是其中的问题之一。采用比较和实证的研究方法,系统地对上传视频侵权的行为性质、构成要件和责任承担方式进行全面的分析,并在此基础上,发现我国在相关立法和司法实践中存在的一些问题,提出完善我国上传视频侵权制度的具体对策。

| Abstract: | The infringements of network copyright emerge endlessly.Because the network users upload others’ copyrighted video without permission,the dispute between internet users and copyright holders becomes one of the problems.By comparative and empirical study,this article analyses the constitutive elements and remedies in detail.Then,it points out some problems in the relevant legislation and judicial practice,and puts forward some specific countermeasures. |
