| 摘 要： | 宪法理论基础是指导宪法理论构建和宪政实践的基本理念。近代宪法的理论基础是限权论。但随着社会的发展,传统严格限权模式不再适应社会需要,现代社会主要通过正当程序、民主参与、社会力量以及媒体等,既授予国家权力,又控制国家权力,宪法的理论基础是控权论。

| Abstract: | The foundation of constitution theory is the basic concept, which instruct people to set up constitutional policy. With the development of society, the traditional strict pattern of restrictive right cannot meet the need of the society. In contemporary age, the society not only authorises state power, but also dominates state power from proper procedure, democratic attending,social power and media. The theoretic foundation of constitution is the theory of dominating right. |
