土地违法现象的省际差异及其动态分析

本文从全国和省际两个层面、案件宗数及违法程度两个角度分析了我国土地违法现象的现状及相关特征,采用锡尔指数和艾肯森指数等方法测算了我国2002-2011年间土地违法现象的区域差异并分析其动态演变特征,最后结合聚类分析的结果对当前的区域差异进行深入分解探讨。结论显示:①我国近10年的土地违法案件宗数呈现三阶段的波浪式下降态势,但涉案面积并未得到有效控制,土地违法程度在10年间不断加深;②非法占地行为成为我国当前土地违法现象的最主要构成因素;③我国土地违法现象的区域差异在近10年间存在先扩大后缩小的倒"U"型态势;④我国土地违法的高发区、次高发区、次低发区及低发区四大区域的总差异中,区域间差异占主导,但2008年以来区域内差异呈扩大之势。

Dynamic Analysis of Provincial Differences in Illegal Land Use Activity Across China

This paper analyzes the current conditions and characteristics of China's illegal use of land nationally and provincially by focusing on the number of cases and their severity. Regional differences in the illegal use of land are measured using the THEIL Index and Atkinson Index and their evolution process is analyzed. In-depth discussion concerning regional differences using cluster analysis follows. We found that violations of land law cases decrease wavelike in three stages; however,areas with these cases are not controlled effectively and cases are increasing in severity. Unlawful encroachment of land is one of the most essential parts of land law violation. The trend in the evolution of regional differences in illegal land follows an inverted U shape, indicating that regional differences grew initially and then decreased. Inter-regional differences dominate overall differences which can be divided as inner-regional differences and inter-regional differences in land law violation. Inner-regional differences have increased from 2008 and there are three different stages. In stage I(2002-2008),inter-regional differences prevail,contributing the most to differences overall and mainly due to the unparalleled large number of high incidence regions. In stage II (2009-2010),inner-regional differences gradually emulated inter-regional differences in contributing to overall differences because of the rapid expansion of differences in low-risk areas. In stage III(2011-present),inter-regional differences dominate because of the shrinkage of inner-regional differences and decrease in low-risk areas.
