| 摘 要： | 不起诉裁量权是检察机关对于是否提起公诉的选择权。目前我国检察机关的不起诉裁量权由于范围过于狭窄、配套机制的不完善而具有很大的不确定性。检察机关的不起诉裁量权应加以扩大，相关的制约机制需要完善。

| Abstract: | The discretion of non-prosecution is the selecection right which the prosecution think the case is unqualified to prosecute,so making the decision to stop the lawsuit.At present,as the range of Non Pros Discretion is too narrow and the affiliated mechanism is not yet perfect,the discretion of non prosecution still has lots of uncertainty in our country.For these reasons,the range of Non Pros Discretion shoule be extended and the related resriction mechanism should be perfected. |
