基层法律援助的困境与对策

基层法律援助管办不分导致管理上存在诸多漏洞，过度追求数量导致办案质量得不到保证，司法公信力问题导致民众对法律援助的较低认同以及必要保障制度的缺乏导致维权效果打折等缺陷。针对相应缺陷．应通过规制法律援助管理机构的管理职能，改变现有的强制性法律援助和自上而下的单一性办案监督模式．推动人民法院对法律援助作出积极回应等措施予以改进，以提升法律援助的办案质量，实现法律援助应有的制度功能。

An Empirical Study on Difficulties and Countermeasures of Basic Level Legal Aid: Pingxiang as an Example

There are various serious problems that maybe destroy the aid system. This paper analyzes the problems and find some possible ways such as regulate aid departments and give them more monitoringto protect this system. These measure will make courts response quickly to people＇s legal requirement and improve the quality of legal aid. Finally, it concludes that these measures would make the legal aid system fuction properly.
