| 摘 要： | 空间权是人类对土地利用由平面向立体形态发展的一种新型权利形式,包含空间所有权、空间利用权与空间抵押权三项内容。保护空间所有权,要确立国家独占与空间他物权民事流转、国家征用及发展公益事业优先、空间无害利用三项原则。

| Abstract: | Space-right is a new right,which is developed by people when using the land from two-dimensionsal to stereoscopic form.It includes three items,that is space-title,right of using space and mortgage on space.There are also three principles.First,space-title is monopolized by the state,but other two rights can enter into civil-circulation.Second,public welfare should take precedence.Third,the use of space should be harmless. |
