| 摘 要： | 诉辩交易是盛行于美国的一项司法制度。作为一种刑事审判方式,诉辩交易存在着诸多可取之处,但又有很多重大缺陷;我国暂时不存在引进这一制度的环境,应慎重对待这一制度的移植。

| Abstract: | Plea-bargaining is a system of administration of justice prevailing in the United States. As a way of criminal judge, it has many advantages as well as disadvantages. For the time being, the situation is not suitable to introduce it. So China should treat the transplanting of this system discreetly. |
