| 摘 要： | 竞争法域外适用有两种引发机制,即传统理论中的"效果原则"和国际私法中的"直接适用的法"理论.这两种机制分别从公法和私法两种不同的角度出发,导致了殊途同归的结果,即使得竟争法有了域外效力.必须明确的是,二者产生的根源和采取的立场的差异,导致了其在本质上存在着天然不可逾越的鸿沟.

| Abstract: | There are two mechanisms that lead to the adaptation of competition law,including "effect doctrine" in traditional theory and "law of direct application" in private international law.Though stated from different points of view,they both offer ways to adapt competition law in the foreign lands.But one thing must be pointed out,that is,the difference between the root and base of them decides that they are different mechanisms in nature. |
