传统进路及宪政分析框架——关于基层政权建设研究的一个导论

理论界对基层政权建设研究的进路不同,从而形成了反差鲜明的政策主张。但是系统内解决国家与社会、权力与权利、中央与地方的关系问题,制度设计就不可避免地具有内生的先天缺陷。本文提出从宪政的视角思考基层政权,运用宪法学思维方式、分析方法来研究基层政权这个在公权力领域带有基础性的问题。

Discussion On Traditional Approach to Study of Grass-roots Governance and Constitutionalism Analysis Framework

Different approaches to the study of grass-roots governance have brought about various remarkably contradictory political advocacies. However, the paper presents that if we are to handle the relations of government and societies, power and rights, central government and local government within the political system, innate deficiency of constitutional design will be inevitable. Thus, it is proposed that the designers should employ constitutionalism approach and analysis method to study the grass-roots issue of governance.
