| 摘 要： | 在WTO争端解决机制运行了若干年之后,一些学者观察到判例在WTO争端解决机制中的地位越来越显著.专家组和上诉机构的报告能否成为有拘束力的先例,学界对此也是仁者见仁,智者见智.本文从目前专家组和上诉机构报告在争端解决机制中地位的现状入手,对产生这种现象的原因进行分析,结合案例及各种理论证明报告目前看来不可能具有先例效果,以期对中国的实践作出一些指导.

| Abstract: | As WTO Dispute Settlement Mechanism was implemented for several years, some scholars have become conscious of the increasing importance of the cases in WTO Dispute Settlement Mechanism. There are various opinions and numerous debates in the academe on the issue that whether the importance of the cases will constantly boost so that Panels and Appellate Body enact laws without judging according to the existing laws. The thesis starts with discussing the present position of Panels/Appellate Body report in dispute settlement mechanism, and after analyzing the causes of such a phenomenon, the author tries to illustrate with cases and theories that a report can not be adopted as a precedent. |
