论作为社会权的公民体育权

根据宪法基本权利的分类,体育权本质上属于社会权之一种。首先,体育权的产生体现了社会权的基本理念。作为社会权的体育权的价值意蕴,强调的是其有由国家积极促进的一面。其次,体育权的"客观价值秩序"功能彰显了社会权色彩。公民体育权对所有国家公权力都具有约束力。但主要地是为立法、行政和司法等国家机关提供行动指南和价值准则。公民并不能据以直接请求国家给付。再次,体育权保障的国家义务突出了社会权特征。作为社会权的体育权,更为注重立法机关与行政机关的受益型保障,而对以司法权为中心的防御型保障注重较弱。但在强调体育权的社会权面向的同时,也要防范无节制的政府福利给付所可能引发的财政、管理、道德危机。

On Sports Rights As A Social Right

In essence, sports rights is a part of social rights according to the classification of the fundamental rights listed in the constitution. Firstly, the generation of sports rights embodies the basic idea of social rights. The national advocation of sports right is underlined in its connotated value as a social right. Secondly, the function of sports rights in objective value order demonstrates the features of social rights. Citizens’ sports rights should be binding on all the public power. However, the rights mainly aim to provide a guide to action as well as the value criterion for legislative, administrative and judicial organs instead of providing a base for state supply. Thirdly, the state obligation guaranteed by sports rights highlights the characteristics of social rights. Being a constituent part of social rights, sports rights lay a particular emphasis on the security of "gain" but not "holding", which mainly protected by jurisdiction. But the precaution for crisis in finance, administration and morality, triggered by immoderate supply of government welfare, should be taken into account when stressing the social-rights-related side of sports rights.
