人力资本产权视野中的高校人才柔性流动

摘    要:根据高等学校聘任方式的不同,可以将人才柔性流动归纳为全职式流动、兼职式流动、项目式流动、咨询式流动、候鸟式流动等5种类型。高校人才柔性流动在取得一定成效的同时,也出现了一些不合理的、无序的流动。从根本上解决这些问题,需要我们正确理解、严格界定人才柔性流动过程中的人力资本产权。人力资本产权为人力资本产权载体所有,通过契约可以将部分支配权、使用权、收益权转让,但不能转让所有权。人力资本产权归属和交易关系到人力资本价值的实现及人才柔性流动的效率。为此,需要从法律保障、契约管理、道德约束、文化建设和社会保障等方面,为高校人才的柔性流动提供保障。

Flexible flow of talents in HEIs from the perspective of human capital property rights

Abstract:According to different ways of recruitment in higher education institutes(HEIs),we can induce the flexible flow into five kinds,the full-time model flow,the part-time model flow,the project model flow,the consulting model flow and the migrant model flow.The flexible flow of the talents in HEIs has made some big progress,but it also appears some problems such as unreasonable and disordered flow.In order to solve these problems fundamentally,the human capital property rights in the process of the flexible flow has to be understood correctly and defined strictly.The human capital property rights carrier owns these rights,and can transfer part of eminent domain,the use right and the usufruct by contract except the ownership.The ownership and exchange of the human capital property rights concerns the realization of the human capital value,and also concerns the efficiency of the flexible flow.So we should take actions to provide guarantee for the flexible flow of the talents in HEIs from many aspects such as legal guarantee,contract management,moral restriction,cultural construction and social security.
