国际法院咨询意见的程序与效力

任何国际组织与任何国家或国际组织之间产生了争端,可通过国际法院的咨询意见制度加以解决。可提出咨询意见请求案的机关有联合国大会、安全理事会及取得联合国大会授权的15个专门机关。咨询提案程序应遵循《联合国宪章》、《联合国大会议事规程》及《联合国与专门机关关系协定》等规定。虽然国际法院的咨询意见对于提出请求者无严格的法律约束力,但其权威性的广泛影响,可以使其发挥极大效力。为进一步提升国际法院之约束力,应在各国际组织基本法中增修接受并履行咨询意见之承诺条款。
