论我国合同法对格式条款的规制

格式条款可以节省时间，有利于事先分配风险，降低交易成本。其弊端在于提供商品或服务的一方在拟定合同条款时，经常利用其优越的经济地位，制订有利于己而不利于消费者的条款．损害缔约另一方的利益，故法律有必要对其予以规制以匡扶正义。我国合同法建立了格式条款的三个规则：订入规则、效力规则和解释规则，对格式条款进行了全面的立法规制。
