| 摘 要： | 学者在探讨情势变更原则适用时产生的法律效果方面，主要阐述受不利影响(或处于不利地位)的当事人享有变更或解除权，但笔者认为，从公平原则出发，相对方在某些情形下亦有向对方请求损害赔偿的权利。本文拟从双方角度全面阐述情势变更原则的法律效果。
