| 摘 要： | 民事审判与行政审判之间的权限划分与协调问题相当复杂，关涉主管权限划分、审理顺序、判决效力之间的协调以及权限冲突四大方面。对此，不仅国外没有统一的制度模式，而且在理论界也存在着较大争议。因此，加强对该问题的基础理论研究并加强相关立法建设实有必要。

There is no same pattern of the systems and no unified opinion aboard. The relevant system is imperfect in China, and it is not fully discussed in the academic field. Therefore, it is necessary to enhance the research of the basic theory . |
