| 摘 要： | 关于高职院校大学生实习就业中的.法律适用问题,学者们现有的研究成果惊人一致:在校生实习期间与用人单位建立的不是劳动关系,在身份上也不认定为劳动者,不受劳动合同法保护.此观点深值商榷.我们应该从大学生切身利益出发,结合用人单位和学校的利益保护,在法律的框架下,就具体问题的解决进行探索.

| Abstract: | Existing research results of scholars about the application of the law during college students in their employment are similar:The relations between college students and employing units is not labor relations. College students arent protected by labor contract law. This is a highly debatable view. We should explore the specific issue under the legal framework from the interest of college students combined with protection of the employing units and schools. |
